Man’s home searched after police discovered social media videos showing him with both cannabis and firearms

A 33-year-old man from Waterloo, Iowa was sentenced to probation for five years and ordered to pay $1,290 after being found with cannabis and multiple firearms.

The sentence follows a jury verdict this past March in which the man was found guilty of one count of possession of marijuana with intent to distribute, notes a statement from the U.S. Attorney’s Office for the Northern District of Iowa.

A search of the man’s home in September 2020 — sparked by the discovery of his own social media posts showing him with both marijuana and guns — revealed 600-plus grams of weed.

Beyond the bud, the search resulted in two handguns and numerous long guns being found in the same room as the weed.

The potential sentence for a 23-year-old Iowa woman who posted snaps of her holding a weed blunt and speaking about cannabis could prove more severe. Earlier this year, it took less than two hours for a jury to find the woman guilty of possessing firearms while being a cannabis user.

She could spend up to 10 years in prison, be ordered to pay a $317,500 fine and receive three years of supervised release following any imprisonment.

Still in Iowa, the mayor of Jamaica, along with her husband, were sentenced to two years of probation in 2019 after a search of their home revealed 18 homegrown cannabis plants.

Recreational cannabis is illegal in Iowa, with a first offence for possessing any amount treated as a misdemeanour punishable by six months in jail and a $1,290 fine, according to the National Organization for the Reform of Marijuana Laws (NORML).

Possession with intent to distribute 50 kilograms or less of cannabis, however, is a felony that carries a maximum of five years in prison and a $9,675 fine upon conviction, NORML reports.

Feld Law Firm points out that “for a person to be found guilty of possession with intent to distribute, the state must prove beyond a reasonable doubt that a person possessed the marijuana and intended to distribute it.”

Some indicators of intent include if the drugs are in individual plastic bags, the amount of cannabis involved and if the marijuana is organized by type.
