Legislators in San Francisco File Initiative to Locally Decriminalize Psychedelics

Last week, legislators in San Francisco filed a measure to locally decriminalize psychedelics such as ayahuasca and psilocybin. The resolution, which also calls for broader statewide reform, was sponsored by Supervisors Hillary Ronen and Dean Preston. The measure’s enactment by the Board of Supervisors would make the city of San Francisco the largest in the country by population to deprioritize the enforcement of laws that prohibit entheogenic substances.

The “whereas” section of the proposal talks about the traditional role that psychedelics play as catalysts for profound experiences of spiritual and personal growth, as well as the therapeutic potential of these substances. The proposal also mentions a bill introduced by Sen. Scott Weiner that was approved by the Senate. The bill in question would legalize the cultivation, possession and sharing of small amounts of psychedelics, including DMT, MDMA and psilocybin for individuals aged 21 and above. Weiner’s measure has since cleared a pair of assembly committees and is scheduled for consideration by a different panel in the chamber this month.

In addition to this, the San Francisco resolution also discussed Oregon’s vote to eliminate criminal penalties for the low-level possession of all illicit drugs as well as local moves to decriminalize psychedelics in cities such as Oakland. If approved by the Board of Supervisors, the measure would urge law enforcement to make enforcing laws that prohibit psychedelics-related activity such as the purchase, cultivation, transportation, distribution and possession by adults, the lowest priority for the county and city of San Francisco.

It also stipulates that no city resources should be used to conduct any investigation, arrest, prosecution or detention of individuals based on supposed violations of federal and state law on the use of entheogenic substances classified under Schedule I in the Controlled Substances Act. In addition, the proposal, through the board, implores the mayor to instruct federal and state officials and lobbyists in the city to support efforts to decriminalize entheogenic substances and plant-based compounds that are classified under Schedule I.

It should be noted that a hearing on the resolution is yet to be scheduled as board members haven’t returned from recess.

This measure’s introduction is the latest move in a national reform movement that’s seen states and cities across America work to advance the decriminalization of psychedelics both at the ballot and legislatively. The first city to enact psychedelics decriminalization was Denver, which did so in 2019. This move prompted legislators and activists elsewhere to follow suit by introducing their own initiatives.
