Add tossing an empty alcohol bottle out of the car window at a drive-thru as one more way to attract police notice and get busted for illegal cannabis.

That’s what two car occupants learned during an ill-timed toss at a restaurant drive-thru in Bowling Green, located about a half-hour drive away from Toledo, at 4:15 a.m. on Oct. 23, according to BG Independent Media.

The questionable littering sparked a call to the Bowling Green Police Department. It’s not clear who tossed the bottle, per the Sentinel-Tribune, but the officer responding to the criminal mischief complaint noticed the smell of marijuana as he approached the driver.

The officer ultimately found that the driver didn’t have a licence, as well as confiscated 26 grams of cannabis and a firearm, reportedly wrapped in a towel on the floorboard, with 14 rounds of ammunition.

While recreational cannabis is illegal in Ohio, amounts under 100 grams have been decriminalized. “Violations in this range are minor misdemeanors, meaning that there is no jail time involved and convictions are not included on a person’s a criminal record. However, violators may be fined up to US$150 ($203),” notes information from Super Lawyers.

The charge does not become a felony until the possession amount involved is more than 200 grams of weed. Upon conviction, the maximum penalty would be a year in jail and a fine of US$2,500 ($3,375), according to the National Organization for the Reform of Marijuana Laws.

An 18-year-old has been cited for possessing cannabis and driving without a licence, while a 20-year-old was charged with improper handling of a firearm in a motor vehicle and carrying a concealed weapon, media reports indicate.

Tossing an alcohol bottle from a car window — Ohio has an “open container” law meaning an open bottle of alcohol in the car is off-limits even if the driver is completely sober — is a clear no-no, but plenty of drivers and car occupants have been nabbed for weed for being even more obvious than that.

There was the New York state man who tossed about a pound (454 grams) of cannabis out of his vehicle window, later found by the side of the road, after being ordered to stop by police in late 2020. The man was later charged with criminal possession of marijuana in the second degree.

Leaving a trail for police or doing dumb stuff right in front of officers is never a smart move. Consider the driver in Illinois who allegedly tossed a bag of cannabis out the vehicle window prior to police pulling him over for a traffic violation, an Australian man who ripped open bags of weed and tried to dump them after having been stopped for dangerous driving and a B.C. man who was seen tossing a joint out his car window while speeding near a playground.
