Parsing the ‘What We Heard’ report on Canada’s cannabis framework

The recent marking of the 5-year anniversary of cannabis legalization has raised numerous observations about the sector’s issues. While most of the statements I’ve read have expressed a business perspective, there’s no shortage of other opinions. A broader telling of our collective experience can be found in The Legislative Review of the Cannabis Act: What We Heard report, the first big shoe to drop in the mandated review of the legislation and its implementation. 

The report was released in October following six months of consultation with stakeholders and serves as a scoping document for the final report before its tabling by March 2024.

There will be some further listening but those hoping for major changes to the cannabis framework are likely to be disappointed. The expert panel undertaking the review were asked to examine how the framework is working in practice. Their task is to suggest how to make it work better, not challenge its main purpose or approach.

It’s a noteworthy piece of work, laid out in key subject areas each including an overview of measures set out in the cannabis framework with data and observations as context for what informants told the panel. To appreciate the findings, it’s worth considering the panel’s makeup and the affiliations of those presenting their views.

The panel is chaired by a former federal deputy minister of health and justice, two professors of psychology/psychiatry, an expert in mental health & addictions, and an indigenous criminal lawyer. They heard more than 200 presenters from the cannabis industry; First Nations, Métis and Inuit; public health agencies and academics; a range of public sector organizations including provincial governments, police agencies and U.S. states; and a myriad of groups representing youth, criminal justice, wellness, and other interests.

The report covers most of these areas as well as home cultivation, adult access, criminal deterrence and access for medical purposes. 

The nature of the exercise suggests that the deck is already stacked against the common concerns of cannabis businesses, such as excise tax and regulatory costs, barriers to legal market entry, advertising and promotion restrictions and the like. The panel notes, however, that its suggestions for reform may exceed parameters of the Act and its regulations since the federal framework encompasses legislation, policies, and programs across Canadian jurisdictions.

Because of this, the panel infers that the federal government has some overall responsibility for economic and business concerns, including those delegated to provincial governments. So, despite the report’s heavy emphasis on health and social impacts, it recognizes that keeping cannabis out of the hands of youth requires a sustainable, legal business sector. Whether the final report will make specific industry-friendly recommendations, though, is far from certain. 

I was also struck by the concerns of stakeholders that I generally don’t see on the industry’s radar:

  • Cannabis-related child poisonings have doubled from 2019 to approximately 2,400 in 2021, mostly from ingesting edibles. Related emergency department visits and hospitalizations are up 14 per cent over two years to 21,658 visits in 2021. 
  • While the age of initiating cannabis use is unchanged, several interest groups are concerned about the relationship between cannabis use and the mental health among youth and young adults. 
  • Although the panel understands the industry’s position on the excise tax, it’s not clear that it cares. Some health stakeholders want to maintain fees, which they see as a deterrent to further consumption and a source of research funding. 
  • Health respondents do not want to relax advertising and promotion requirements which they say would lead to “over-commercialization” of cannabis. 

While this is just a slice of the feedback, I had the impression of a parallel universe of stakeholders who are much more concerned about perceived health risks than business viability. 

Having been closely involved in tobacco control activities during the early to mid 2000s, reading the report gave me a feeling of déjà vu.

During that time tobacco taxes were progressively raised to suppress demand, in tandem with extensive public education activities. Products were concealed at point-of-sale while both smoking prevention and cessation programming was amply funded in hospitals, educational institutions and among youth groups. These initiatives were quite successful at dropping smoking rates, although the battle has now shifted to deterring minors from vaping nicotine and from using sublingual pouches. 

Considering all this, I think that the best way for the cannabis industry to address the Cannabis Act review is to engage with more than an eye to beating back taxes and regulatory irritants.

It’s time to collaborate with other stakeholders to address community impacts, ensure a balanced research agenda and to explore joint opportunities. Working with others to strengthen the medical cannabis regime is one example of an area that concerns nearly all groups while offering promise for export markets.

What’s at stake is not just a well-functioning regulatory framework but the future viability of Canada’s cannabis sector.

A lawsuit filed against the state of Mississippi by a medical cannabis dispensary owner has been dismissed. The lawsuit challenged Mississippi’s laws, which the plaintiff said placed restrictions on marijuana businesses by forbidding them from placing advertisements on a majority of media platforms.

In a decision issues last week, Federal District Judge Michael P. Mills agreed with the state’s stance that such operations do not benefit from the constitutional protections afforded to certain types of commercial speech because marijuana possession is still prohibited under federal law.

Clarence Cocroft II, the plaintiff, founded Tru Source Medical Cannabis in 2022 following Mississippi’s legalization of medical cannabis use for patients with life-threatening illnesses. However, he claims that because the state forbids medical cannabis companies from running advertisements in any medium, he has had difficulty attracting consumers.

Cocroft, who was represented by the Institute for Justice, a nonprofit libertarian law firm, filed a lawsuit against Mississippi’s Alcoholic Beverage Control Bureau and the state’s Health and Revenue Departments. His claims revolve around the purported infringement of his advertising rights, stating that the limitations imposed by the state prohibit him from running advertisements in periodicals, newspapers, radio, television and billboards.

In his decision, Judge Mills stated that he believed it would be a major violation of state sovereignty to remove Mississippi’s prohibitions on marijuana advertising. He stressed that the state’s legislature had outdone the U.S. Congress by legalizing cannabis to some degree. This, in Mills’ opinion, called into question the jurisdiction of a federal court to tell the Mississippi legislature how far it may take cannabis legalization.

Expressing dissatisfaction with the ruling, Cocroft maintained that Mississippi’s rules violate businesses’ First Amendment rights. He stated that he plans to file an appeal with the Fifth U.S. Circuit Court of Appeals over the ruling. While the state can’t restrict dispensaries from displaying signs on their premises or showcasing products on their websites, Cocroft’s attorneys maintain that the broader advertising restrictions imposed by the health department are unconstitutional.

Marijuana is still classified as a restricted substance under federal law, even though President Joe Biden has pardoned thousands of individuals who were found guilty of using cannabis and of simple possession on federal property. Mills emphasized that states have the right to control marijuana advertising as long as it is still illegal on a federal level, bolstering Mississippi’s jurisdiction to regulate how the substance is advertised.

This lawsuit filed in Mississippi highlights some of the challenges that cannabis enterprises, including major actors such as Cronos Group Inc. (NASDAQ: CRON) (TSX: CRON), have to contend with in the different markets in which they operate. Reform has been slow and incremental, but the industry hopes that all vestiges of the era of prohibition will be reversed as the public and policymakers gain a deeper understanding of the industry.

Alberta makes changes to cannabis sampling rules, event sales, and more

Alberta Gaming Liquor and Cannabis (AGLC) made several updates to their  Retail Cannabis Store Handbook and the Cannabis Representative Handbook Cannabis this week, effective immediately. 

The changes relate to authorizations to sell cannabis at age-gated events, new guidance for cannabis sampling, and cannabis sales between retail stores, among other changes.

Following changes last year when AGLC began allowing producers to provide product samples to retailers, the provincial agency has now made amendments to its rules to allow samples of packages larger than 3.5 grams. 

Under the new rules, if a sample product is not available in the 3.5 gram size, the smallest available size of the product may be provided as a sample. Each product may be sampled no more than twice per calendar year.

Licensed cannabis retailers may also now apply to AGLC for a licence extension for the purposes of selling cannabis at a minors-prohibited entertainment event or cannabis industry trade show.

In addition, cannabis sales between licensed cannabis retailers, regardless of ownership structure, are now permitted in Alberta. The required 120-day wait time between cannabis transfers has also been removed to allow unlimited transfers of cannabis products between licensees owned by the same legal entity.

Another change is that licensed cannabis retailers are now able to apply to AGLC for a licence extension for the purposes of selling cannabis at entertainment events or cannabis industry trade shows. These events must be age-gated to prevent minors. 

Cannabis retailers can now also leave cannabis products in locked display cases overnight rather than having to move them to and from locked storage every night and morning. 

This means cannabis products must either be stored in a locked showcase in the customer area or in a locked storage room accessible only by authorized staff.

The AGLC has also updated its policies to align with the agency’s Cannabis Waste Management Fact Sheet 2023.

The Canadian Cannabis Council (C3) announced today that its President & CEO is stepping down.

George Smitherman, who has served as the head of the cannabis industry organization for four years, says he is proud of his work and looking forward to new opportunities.

“(I’m) excited for new opportunities and proud of the work we accomplished over the past four years,” Smitherman told StratCann. “Looking forward to watching the continued evolution of C3 and the Cannabis sector from the sidelines.”

The organization made the announcement in an email sent to its members at 4:19 am on January 31, saying Smitherman has left an “indelible mark” on C3.

“His leadership, thinking, and indomitable spirit have been instrumental in driving positive change for our industry and fostering a culture of collaboration and excellence among our members,” wrote Rick Savone, Chair of the Cannabis Council of Canada. “We extend our heartfelt thanks to George Smitherman for his service and wish him nothing but success and joy in his future endeavours.”

“George is stepping down after four successful, eventful years as our President. C3 is now beginning a recruitment campaign to succeed him,” Savone added in an email to StratCann. “The organization has grown exponentially over George’s tenure, and our work as the leading industry association representing producers is more impactful than ever. In a few weeks, we’ll have a new organizational leader and our achievements will continue to generate benefits for our members. We’re eager for this next stage of development, both for George and for C3.” 

The Canadian Cannabis Council’s board says they will now begin a formal search for a new Executive Director and encourages those interested in the position to send their application to [email protected]

In the interim, C3 Treasurer Tamara Lovi and C3 Secretary Elisabeth Sieber will assume the role of Acting Co-Executive Directors, ensuring the smooth continuation of C3 operations. 

The Board says it has been working to define its strategic priorities for 2024, with a mandate to continue to push for financial viability, a level playing field with the illicit market and enhanced communications to consumers.

The Cannabis Council of Canada bills itself as a national and international representative of the country’s licensed producers and processors of cannabis, with a mission to promote industry standards, support the development, growth, and integrity of the regulated cannabis industry, and serve as an important resource on issues related to responsible use of cannabis for medical and non-medical purposes.

Smitherman has a long history in Ontario politics. He started with C3 in March 2020. Previously, he had worked in the cannabis industry in various roles. He was also a candidate for Mayor of Toronto in 2010 and served as the Ontario Minister of Energy and Infrastructure and Deputy Premier of Ontario from 2008-2009, and the Minister of Health and Long Term Care, Deputy Premier of Ontario from October 2003 – June 2008.

Smitherman was also previously a member of the Ontario legislature from 1999 to 2009, and was the first openly gay MPP in Ontario’s history.

After years of living overseas in six cities across four European countries, there is no greater moment visiting family in the Empire of Lies than when it’s time to depart again. Don’t get me wrong, the reunions are sentimental and touching. The hugs and laughs are therapeutic, but nothing beats the high of leaving again.

When we arrived at the Tucson airport in the late morning, the temperature was already well past a hundred Fahrenheit (38C). I went through the Ryan Bingham express line for Sky Team members, checked my bags, grabbed my boarding pass, and headed for the American Patriot Act demoralization ritual at the security theatre outpost before the terminal.

At the entrance, I noticed three lines. One for pre-check TSA members who give their DNA to the feds for convenience, one for the citizen tax-paying slaves, and one for the regime’s preferred class of new American dreamers.

The rumors were true.

Dozens of illegals stood in a dedicated express line holding new phones, DHS paperwork that guaranteed boarding and served as their new identity documents since they “lost” theirs on the perilous journey through a coterie of global NGOs stationed across Central America and Mexico that gave them maps in their native languages, prepaid debit cards, food, water, and sometimes temporary shelter.

There were children as young as maybe four or five standing awkwardly next to men and women who were not their parents. They certainly didn’t behave as children do around their parents. These adults were their handlers working for DHS contractors, collecting millions to escort them around the country. This is nothing less than government-funded and sanctioned child trafficking and it has probably been going on for years, if not longer.

The government has spent $20 Billion on this human trafficking operation in the past three years with as many as 8-10 million new invaders sent to various states and cities to further milk local governments dry.

Not surprisingly the citizen debt slaves around me found nothing unusual in any of this. Most of them wiled away the time in line flicking their thumb across their screens before the customary humiliation and molestation at the security theatre checkpoint. Once we got through, we were all…

He is also the “inventor” of The Great Replacement theory. This “invented theory” involves tens of millions of mostly Arabs, Africans, and South Asians (mostly Muslims) replacing ethnically white European races, in their own nations.

It’s just a “theory” though.

It hasn’t been happening in practice since Germany invited temporary Turkish guest workers to help engineer their economic “miracle” in the 1960s using billions of U.S. dollars. Since there is nothing as permanent as a temporary government program, the Turkish population in Germany is now over nine million.

Many of them speak German and hold German passports but consider this: If the President of Turkey Recep Tayyip Erdogan got ideas from watching Napoleon or reading about Ghengish Khan or Alexander The Great or whomever the Ottoman equivalent was, he could incite a Turkish insurrection and topple Germany within a week and pronounce himself the new German Emperor, or Sultan.

Does that make these people German?

The Turks don’t include the millions of other Arabs, Africans, and South Asians that Frau Wanderlust invited in 2015. Germany’s foreign-born population or foreign citizen population is now teetering on a quarter of the country, and that will hit a multiplier effect since these people breed like rabbits and Germans have permitted the natives of their nation to be infested by the toxic combination of feminism, socialism, eco-marxism, and cucksterism—none of which help with procreation.

There hasn’t been any Great Replacement in France either, where millions of immigrants from all her former Magrehbi and Sub-Saharan colonies have invaded the homeland.

When I spent a year in Basque Country I strolled into the “old town” or Casco Viejo of a medium-sized city. How many would head for Texas if they knew the odds they would end up back in Quito after a two-month hike was 50-50? What if it was 80-20?

The invasion of Texas would stop within a few months once word got around. All the governor is doing is ensuring that once New York and California go bankrupt, Texans will be bailing them out while all those he bussed to their cities will be headed to Texas in uHauls where they will elect Henry Cuellar the next Governor and at that point they might as well rename the state Texico.

Everything happening right now around the border issue is to rouse political divisions, enflame tensions, and distract the masses from bigger things just around the corner involving the U.S. dollar’s final death knell and a reset of the global fiat monetary system. Perhaps even bank bail-ins after massive bank runs and engineered financial panics. (Beware the Ides of March)

On an episode of Alex Jones’s InfoWars last week he and Michael Yon discussed the open border calamity and the invasion of 8-10 million third-world “immigrants” under the Biden Administration.

They even put up a screenshot showing the Hebrew Immigrant Aid Society building next to a massive holding center labeled “China Camp.”

Alex Jones has been accused of being “controlled opposition” for years. I avoid using that term willy-nilly since I’ve been accused of it privately in emails from past subscribers who thought I was paid to peddle an agenda here.

But now I have my suspicions about Jones as well.

Watch Alex Jones’s broadcast on September 12, 2001, and his direct criticism of the “Chicoms” and then watch him with Stew Peters in December, a man who has noticed a lot recently, and you’ll see two very different Alex Joneses.

When he was young and fearless, he noticed the “Chicoms” were not the ally that Con Inc. and Neocons proclaimed, and that they were very dangerous and “would get a lot of Americans killed in war.” Which is exactly what happened in the following two decades. Those wars strengthened the “Chicoms” while destabilizing and fiscally destroying the United States.

Today Alex Jones sounds like Cathy Newman interviewing Jordan Peterson in his Stew Peters conversation when it comes to criticizing the “Chicoms” and noticing serious connections regarding who is really behind the demographic destruction of the United States AND Europe.

But the purposeful obstruction of the truth is now just downright sad when you make a few rudimentary connections, rendering Jones a theatrical parody of his former theatrical self. While Michael Yon has done a lot of recent noticing on X lately, so credit to him for that.

The current head of DHS (charged with “Homeland Security”) is Alejandro Mayorkas, who also happens to be a former BOARD MEMBER of HIAS.

Funding for his former NGO exploded since he was appointed head of DHS.

The U.S. Department of Justice has revealed that it will ask a federal court to dismiss a lawsuit seeking to block the federal government from enforcing cannabis prohibition in state-level cannabis markets. Several industry stakeholders and cannabis businesses teamed up in May 2022 to sue the federal government over what they said were unconstitutional policies harming their operations. The group was represented by two leading law firms, including Boies Schiller Flexner LLP, which has represented clients such as former Vice President Al Gore and the Justice Department.

According to the lawsuit, enforcing cannabis prohibition in state markets is unconstitutional and creates a public risk while preventing licensed cannabis businesses from accessing critical financial services despite paying taxes. The suit was filed by Wiseacre Farm and Canna Provisions from Massachusetts, Treevit CEO Gyasi Sellers, along with multistate marijuana operator Verano Holdings Corp. (CSE: VRNO) OTCQX: VRNOF) in the U.S. District Court for the District of Massachusetts, Western Division.

However, in a document filed earlier this week with the U.S. District Court, the Justice Department noted that Attorney General Merrick Garland will file a “motion to dismiss and supporting memorandum” on the Tuesday deadline. That news comes only one month after the plaintiffs and the DOJ jointly agreed to request a deadline extension for initial brief filing. Both parties submitted a joint filing asking the court to extend the deadline by 28 days and push it to Jan. 26, 2024.

If the federal government does file a motion to dismiss, the plaintiffs will have until March 15, 2024, to submit an opposition response and up to April 5, 2024, to submit any additional replies. The DOJ is also asking for permission to submit a memorandum exceeding the 20-page limit as it will present arguments on “multiple issues of constitutional law.”

According to Ascend Wellness Holdings founder Abner Kurtin, the lawsuit is an “industry-wide effort” seeking to block the federal government from impeding intrastate cannabis trade. The suit argues that interstate cannabis trade prohibitions are “unjustified vestiges’” of long-abandoned prohibitionist policies at the state level.

With dozens of states legalizing medical and recreational cannabis over the past two decades, the suit alleges that interstate commerce prohibitions by the federal government are an “unjustified intrusion of federal power” that harms the cannabis sector and lacks any national purpose.”

The plaintiffs are also challenging tax provision IRC 280E, which prevents cannabis businesses from making tax deductions. American Trade Association of Cannabis and Hemp president Michael Bronstein said he believes that tax provisions, as well as the Controlled Substances Act, are being “misapplied to legal cannabis businesses.”
